Recent Positive Court of Appeals Decision Aided by Amicus Brief Drafted by RRM Attorneys

RRM attorneys Tim Sullivan, Jennifer Early and Mary Haasl recently submitted a brief to the Minnesota Court of Appeals on behalf of the Minnesota School Boards Association as amicus curie in the case of Vitek v. City of Eagan, et al.  That case concerned a fatal motor vehicle accident involving a public school student occurring on a county road and outside of school hours.  The Minnesota Court of Appeals held in relevant part that the school district was entitled to  dismissal from the case because any duty owed by the school district to the student did not extend to areas and activities outside of the school district’s direct control, including the motor vehicle accident occurring off school property and outside of school hours.  This opinion can be accessed online: https://mn.gov/law-library-stat/archive/ctapun/2023/OPa221536-070323.pdf
